Backstage Update On The Concussion Lawsuits Against WWE

On October 5, US District Court Judge Vanessa L. Bryant (for the District of Connecticut) ruled that the lawsuits against WWE from the estate of Nelson Frazier Jr (Big Daddy V) and Michalle James (mother of Matt “Doink the Clown” Osbourne’s children) be consolidated into one case, along with the lawsuits by Billy Jack Haynes, Vito Lograsso, Evan Singleton, Ryan Sakoda, Matt “Luther Reigns” Wiese, and Russ McCullough over WWE’s lack of protection for the health of performers. The lawsuits specifically mention concussions, CTE and other head-trauma related injuries.

WWE filed a motion asking for the court to speed up the process in finding out if any other former talents plan to file lawsuits, based on communication they received from attorney Konstantine Kyros. Kyros filed an amended complaint which eliminated the John Does. The court originally ruled that it would veto the need to expedite information but then said they were only talking about the cases against WWE, not the lawsuit WWE filed against Mulligan and others, as they haven’t made a final ruling on that yet. WWE has until November 20 to respond.

The attorneys for Blackjack Mulligan, Dynamite Kid, Ivan Koloff and Koko B. Ware filed a motion to dismiss WWE’s case against them, as they said WWE’s argument about their contracts being time-barred is incorrect as three of the four never had these deals. WWE has until November 20 to respond. They have until October 16 to argue that Connecticut law be applied to their lawsuit involving Hanyes, who would then have until October 30 to respond. They’ve also filed documents that reveal intent to bring motions to dismiss the lawsuits from Singleton and McCullough.

In a statement in July, WWE said: “It is unfortunate that some former performers have been improperly recruited under the guise of a big ‘pay day’, and we feel badly that these individuals are being misled and exploited.”
