Attorneys for Heather Clem-Cole have responded to the lawsuit against her by Hulk Hogan over the sex tape of the two that was posted by Gawker.com online. They filed a motion on January 25 asking for it to be dismissed.
Her attorneys claim that other than the fact she’s in the video, there’s nothing to prove that she “at any time had custody or control” of the tape and that Hogan does not say when the video may have been given to a “third party” or when it went to Gawker. Since there is no direct proof she was behind the tape going public, Hogan can’t sue.
Her attorneys also say that many of Hogan’s claims fall under Florida law since there is no proof. Hogan is currently seeking $100 million in damages and is trying to have the video removed from Gawker.
