The jury in the Hulk Hogan/Gawker case has awarded Hogan an additional $25 million in punitive damages. Variety reports that the jury came back today with the punitive result which is in addition to the $115 million in compensatory damages that he was awarded last week.
The $25 million includes $10 million from Nick Denton, who owns the media outlet; $15 million from Gawker itself; and $100,000 from A.J. Daulerio, who was editor-in-chief at the time that the clip of Hogan having sex with Heather Clem was posted to the site.
Gawker has already stated their intent to appeal the result, and the appeal could be much more favorable to them than the initial lawsuit. CNN Money reports that there were nearly 1,000 pages of previously-sealed documents that were not able to be shown to the jury, and they suggest that Hogan may have known he was being filmed. They show that Bubba Clem told the FBI while they were investigating an alleged extortion of Hogan than the WWE alum knew he was being recorded, although he said the opposite in subsequent depositions. Heather Clem also reportedly says that she knew she was being filmed, but she said otherwise in sworn testimony.
The documents also include text messages between Hogan and Bubba Clem which suggest that Hogan was more concerned about the racial slurs he was captured expressing than the sex footage itself. This could be a big key for Gawker’s appeal, as they show that Hogan’s emotional distress (a big part of his claim against Gawker) was in regard to something that the website did not mention or report on. The racial tirade only came to light after Hogan filed the lawsuit. $60 million of the $115 million that was awarded in compensatory damages were due to emotional distress.
