Kevin Kelly & Tate Twins Defamation Lawsuit Against AEW Update – Kelly & Tate Twins File Appeal Over Private Arbitration Ruling
As noted before, former AEW commentator Kevin Kelly and former AEW and ROH talents The Tate Twins (Brandon & Brent Tate), former The Boys, filed a defamation lawsuit this past September against AEW, AEW CEO Tony Khan, and AEW/ROH commentator Ian Riccaboni. This lawsuit was ruled this past June to be officially moved to private arbitration.
Post Wrestling and Wrestlenomics’ Brandon Thurston reported that Kelly and the Tate Twins appeals case against AEW was filed on Tuesday before the 11th Circuit Court. Thurston reported that Kelly and the Tate Twins are currently trying to reverse the district judge’s decision to send their defamation case to arbitration.
In the filing, Kelly and the Tate Twins’ attorney Stephen P. New argued that the district judge erred in not allowing discovery before ruling and by ruling that they didn’t attack the delegation clause. New also claimed that the arbitration clauses in their talent contracts were both substantively and procedurally unconscionable and claimed it created a standard of unfairness which would make them unenforceable.
In the filing, Kelly and the Tate Twins claimed that the judge sent their case to arbitration too quickly and the arbitration clauses in their contracts were so unfair that they do meet the very specific legal standard required to prevent a judge from enforcing arbitration.
Kelly and the Tate Twins also claimed they couldn’t negotiate the clauses, they weren’t told about the costs of arbitration, they have to arbitrate in Florida even though they don’t live there, they weren’t told the rules of arbitration, they were pressured to sign, and had no real choice over it. They current claim that this meets the high “unconscionability” standard.
