As noted before, a group of WWE shareholders filed a lawsuit in November of 2023 against former TKO and WWE Executive Chairman Vince McMahon over claims that McMahon had engaged in a “sham sale process” for WWE’s sale to Endeavor. WWE executives were ordered by the court this past December to turn over documents related to federal investigations into McMahon’s conduct. McMahon, WWE CCO Paul “Triple H” Levesque, WWE President Nick Khan, and others have also been accused of destroying evidence related to the lawsuit. A judge had ruled this past March for redactions in the lawsuit to be removed. Both McMahon and Khan were recently sanctioned by the court for destroying evidence related to the lawsuit case.
Post Wrestling’s John Pollock reported that Judge Travis Laster ruled in favor of Post Wrestling and Wrestlenomics’ Brandon Thurston over him challenging redacted items in the lawsuit.
Thurston had challenged the continued confidential treatment of various filings, such as a voicemail from TKO CEO Ari Emanuel to McMahon before the TKO merger deal.
Thurston reportedly has waived the right for the defendants to disclose any personal information and has challenged the second and third categories.
In his ruling, Judge Laster stated that the defendants did not meet the burden of persuading the court to maintain confidential treatment over their argument to keep information of “low interest to the public” confidential over claims its disclosure would “impose significant costs to the litigant” to WWE. Laster ruled that the defendants were unable to argue that the harm outweighed the public interest.
In a recent episode of the Pollock & Thurston on Post Wrestling podcast, Thurston gave his reasons for why he had challenged for redacted information in the lawsuit to be unsealed.
“I argued that it is relevant information. Not necessarily because I’m trying to unveil who the Wall Street Journal sources are, but because this is relevant information about, perhaps, the factional atmosphere in the board and who certain board members suspected were giving information to the press. I even messaged (Wall Street Journal reporter) Joe Palazzolo before filing that to make sure he was comfortable, and he said, ‘Yes, go for it.”
