There was an emergency hearing that took place in Tampa, Florida today in Hulk Hogan’s ongoing lawsuit against Gawker.com over the release of his sex tape with Heather Clem. Gawker had appealed the temporary injunction that Hogan received ordering all of the video clips and descriptions of the tape removed from their website. As we previously reported, Gawker had taken down the videos but refused to remove the description.
Gawker prevailed in the hearing as the court agreed to stay the order regarding the description of the tape, citing First Amendment rights. The removal of the footage was not argued against.
Hogan has now filed a motion asking that Gawker be held in contempt because they refused to adhere to the court order and placed a link to the footage on another site as soon as they removed the footage from their own. The argument by Hogan’s lawyers is that the link violates the order Gawker is under and that Gawker should pay monetary damages as a result.
