As noted before, Colt Cabana filed a lawsuit last year against CM Punk claiming that Punk failed to uphold his promise to reimburse all of Cabana’s legal fees from last year’s Dr. Chris Amann defamation lawsuit. Cabana’s initial lawsuit was dismissed last November due to the court’s issues with Cabana’s claims but was legally allowed to file an amended lawsuit last December.
In an update to Cabana’s lawsuit status, PWInsider’s Mike Johnson reported that the judge of the case, Judge Daniel Kubasiak, dismissed one of the two counts in Cabana’s amended lawsuit on March 15th.
Judge Kubasiak allowed Cabana’s claims of Punk breaking his promise to reimburse Cabana’s legal fees to go forward due to it “constituted an offer sufficient at this stage so as to establish that an enforceable contract exists between Colton and Brooks.”
However, Cabana’s claims of Punk committing fraud was dismissed due to Judge Kubasiak ruling that Cabana failed to legally establish that fraud was committed under the standards of Illinois state law. Similar to his initial lawsuit, Cabana was allowed the legal ability to amend his lawsuit if he wishes to continue to pursue fraud claims against Punk.
