Hulk Hogan’s lawsuit against Gawker was discussed on Good Morning America today. Hogan is suing for $100 million after Gawker released his sex tape with Bubba the Love Sponge’s wife Heather Clem. The tape leaked in 2012 and was seen by two and a half million people before it was removed. The case is likely headed to trial, which makes Hogan the first celebrity to actually go to trial over a sex tape. Most of the lawsuits over sex tapes are either dropped or settled.
Hogan’s lawyer said: “The law says if somebody is in a private place, doing private things, they have a right to do that, and they have a right to not be filmed without their knowledge, and they have a right for that film not to be played to the world.”
While Hogan claims his privacy was violated, Gawker may have an edge. The website argues that since Hogan has made his sex life public through interviews over the years, he made the sex tape a newsworthy story. If they can successfully argue that the tape was news, they may be able to win the case.
