According to a report by CNBC, the Standard & Poor’s Global Ratings cited an increase in sports brain injury claims after a recent class-action lawsuit against the WWE by more than 50 former professional wrestlers. According to the S&P, a recent class-action settlement between NFL and thousands of former football players is ultimately what paved the way for these claims in the United States and United Kingdom.
Amateur and professional rugby players might be another area where players look to sue, as well as sports that involve helmets being worn to prevent head injuries. Entities that could be targets for upcoming lawsuits include athletic groups, sports teams, schools, retailers and also helmet makers.
A report by S&P analysts based in London and New York stated, “We don’t believe that sports-related brain-injury claims will match the scale of asbestos-related claims for mesothelioma and asbestosis in either the U.S. or the U.K. However, there are noteworthy similarities between the two types of claim.”
With regards to how insurance companies may react to the increase in lawsuits related to head injuries, the report added, “U.S. insurers have learned from their experience of asbestos-related claims and are increasingly drafting exclusion clauses for concussion claims and capping concussion lawsuit payouts.”
