Judge Denies DA’s Request To Drop Charges Against Jimmy Snuka

According to TITLEThe Morning Call, Lehigh County Judge Kelly L. Banach has denied a request from Chief Deputy District Attorney to drop the homicide charges against Jimmy Snuka.

Banach had previously ruled in June that Snuka was incompetent to stand trial, and since that time, the DA has filed two motions to have Snuka, who is free on bail, involuntarily committed to a mental hospital. The DA also filed a motion, which asked that Snuka be compelled to participate in outpatient mental health treatment for 60 days “to ascertain whether the defendant can be competent to stand trial.”

With the judge seemingly not wanting to rule that Snuka can stand trial, the DA requested that the charges be dropped. Chief Deputy District Attorney Charles Gallagher stated the following today to the judge…

“If you believe that he’s not going to become competent, then what’s the point? We ask you to dismiss the charges.”

Snuka’s defense attorney, Robert Kirwan, agreed with Galalgher’s request to have the judge dismiss, saying Snuka’s dementia continues to worsen. The judge stated that she did not feel comfortable dismissing the charges at this point, and said she still wanted to revisit the case in December when Snuka’s competency hearing will resume. The judge also added that she was open to reconsidering her decision if new evidence to drop the charges was presented in court before the end of the year.
